Title: Directions Governing the Acceptance of Donations from External Parties by the National Taiwan Museum of Fine Arts Ch

Content: I.  The National Taiwan Museum of Fine Arts (hereinafter referred to as “the Museum”) has established the Directions Governing the Acceptance of Donations from External Parties by the National Taiwan Museum of Fine Arts (hereinafter referred to as “these Directions”) for the purpose of accepting voluntary donations from external parties in support of matters related to the Museum’s operations.
    Unless otherwise provided by applicable laws or regulations, the Museum’s acceptance of donations from external parties shall be handled in accordance with these Directions.

II.  When accepting voluntary donations from domestic or foreign public or private institutions, organizations, or individuals, the Museum shall issue receipts, periodically disclose donation information to the public, and use the donations for the purposes specified in Article 3 of these Directions, in accordance with the relevant provisions of the Public Welfare Solicitation Act and its Enforcement Rules. The Museum shall also compile and publicly disclose information including the list of donors, donation amounts, and the use of donated funds on a semiannual basis. Within two months following the end of each year, the Museum shall submit a written report on the handling of such donations to its supervising authority for recordation.

III.  Monetary donations accepted by the Museum shall be used for the following purposes:
    (1) Programs undertaken by the Museum in connection with Taiwanese fine arts:
    1. Research and publication.
    2. Planning and organization of exhibitions.
    3. Acquisition, preservation, conservation, and restoration (maintenance) of collection items.
    4. Educational outreach and cultural accessibility programs.
    5. Professional exchanges and personnel visits with museums at home and abroad.
    6. Development of library and digital resources.
    7. Improvement of the Museum’s premises and environment, and the purchase or upgrading of equipment.
    8. Development of the Museum’s operations.
    (2) Other purposes designated by the donor and mutually agreed upon by the donor and the Museum, purposes approved by the competent authority, or administrative and general expenditures associated with the acceptance of donations from external parties.
    
IV.  A donor shall complete the “External Donation Form of the National Taiwan Museum of Fine Arts” attached hereto in triplicate. The form shall serve as the basis for the Museum’s handling of the donation and for subsequent verification. Where the purpose designated by the donor is inconsistent with the purposes specified in Article 3 of these Directions or with matters falling within the Museum’s statutory responsibilities, the Museum may decline the donation.
    
V.  Where a donation has been designated for a specific purpose, any subsequent change in its purpose shall require the consent of the original donor or the donor’s legal representative.
    
VI.  To prevent improper conflicts or connections of interest, the Museum may decline donations from any of the following parties or under any of the following circumstances:
    (1) The donor, including the responsible person of a donor that is a juristic person, and the recipient, including any employee of the Museum, are the same person, spouses, or relatives within the second degree of kinship.
    (2) The donor is a vendor subject to the Museum’s operational supervision, or the responsible person of such vendor.
    (3) The donor is a bidder participating in any procurement tender of the Museum during the tendering period, or the responsible person of such bidder.
    (4) The donor is a vendor (or the responsible person of a vendor) which is currently in a contractual relationship with the Museum, or a vendor (or the responsible person of a vendor) which is within one year after the expiration of the contract, including the warranty period, or after the termination or rescission of the contract.
The Museum may also decline a donation where there is concern that accepting the donation may damage the Museum’s reputation or adversely affect matters falling within the Museum’s statutory responsibilities.
    
VII.  Any matters not addressed in these Directions shall be handled in accordance with other applicable laws and regulations.
